By using our services, you agree to these Terms & Conditions. Please read them carefully. These Terms govern your access to and use of our website Brandically and the services we offer. If you disagree with any part of these Terms, you may not use our Services.

1. Acceptance of Terms

You and Brandically have entered into a legally binding agreement with these Terms. You agree to be bound by these Terms by accessing or using the Site or Services, and you confirm that you have read and understand them.

2. Modifications to Terms

All rights reserved, Brandically may amend these Terms at any moment. Any updates will be posted on the Site, and you will be informed of them by us. Once the updated Terms are posted, you agree to the revised terms by continuing to use the site or services.

3. Unique Design Guarantee

We promise that every logo and website we design for our clients is developed specifically for them, according to their specifications. This guarantees you'll get an amazing design that's specifically suited to your brand.

4. Record Retention

We maintain a record of your final design files after delivery. You can request these files again at any time.

5. Turnaround Time

For the majority of design services, we typically respond within 48 to 72 hours. This timeline is for one design stage iteration only, not for the full project. It might take longer to make revisions (at least 48–72 hours). For your information, here is a breakdown:

  • Orders placed or revisions requested on Monday - Wednesday delivery
  • Orders placed or revisions requested on Friday - Tuesday delivery (by end of day)

6. Customer Support

Our helpful customer service team is here to assist you with any queries or problems from 9 AM to 5 PM, Monday through Friday. If you have any questions after hours, please use the email. We'll deal with them on the following working day.

7. Communication Policy

To be deemed official, any requests for revisions, refunds, and other information pertaining to orders must be made using the Project Camp Account site. Communication through any medium other than Project Camp or phone numbers that are not listed on our official website shall not be held accountable by Brandically. Emails sent to info@brandically.com are accepted as legitimate correspondence. Any delays, problems, or damages resulting from contact via prohibited means are not our responsibility. Regarding information provided through our official websites, we assume full responsibility.

8. 100% Satisfaction Guarantee

We offer a 100% Satisfaction Guarantee. We will keep revising your design until you are completely satisfied (depending on your chosen package).

9. Domain & Hosting

  • Delivery: Final design files are delivered to your "My Account" section within the timeframe specified on your order confirmation. You will also receive an email notification.
  • Revisions & Refunds: All revision and refund policies are subject to the date and time the design order is delivered to your "My Account" area.
  • Email: We deliver custom design orders via email within 5-7 business days of receiving your order.
  • Rush Delivery: For an additional $100, you can receive your first logo/website samples within 48 hours through our Rush Delivery service.
  • Technical Support: Brandically is primarily a design service provider. We design and develop services based on your needs. Some packages may include technical aspects to assist with websites and emails. Brandically will provide basic information and settings required for these services to function. However, we are not responsible for providing detailed training or installation on your end. Here's a breakdown of some technical aspects:
    • Website Deployment: We can deploy your website on a hosting server provided by us (free service). This hosting service is acquired from a third-party provider.
    • Customer-Hosted Websites: If your website is hosted on a third-party server, Brandically is not responsible for any server or hosting-related issues. We also do not offer a Service Level Agreement (SLA) for technical assistance or service outages unless purchased separately as an ongoing maintenance service.
    • Website Content Management System (CMS): We will provide a user manual for your website's CMS. However, we will not be responsible for training you on its use.
    • Email Setup: We will provide the necessary settings and information for you to install emails on your end. We are not responsible for installation or troubleshooting email usage. Since our emails are on open servers accessible by all service providers, Brandically is not responsible for any customer failure to execute, install, or learn the usage of these services.

10. Non-Disclosure Agreement (NDA) & Reputation Management

Brandically keeps customer information and project details strictly secret. Without your express permission, we don't disclose this information to anybody.

Brandically and the customer both consent to refrain from purposefully slandering or disparaging one another in relation to issues that may arise after the project is finished.

Both parties commit to abstaining from any direct or indirect derogatory remarks on the other.

11. Content Creation & Population

Without a separate purchase, Brandically is not in charge of producing or adding content (such as text or images) to your website. We will provide material especially for your website if you decide to buy content creation. Upon your permission, we will also obtain stock imagery from websites that host stock photos and add your specified product photographs and details to your website. Any resemblance between the photos on your website and those on other websites is not Brandically's fault.

12. Refund Policy

With our infinite revision policy (free), which enables you to improve your first design brief with help from our account manager, Brandically ensures 100% customer satisfaction.

You are not permitted to post or use the designs online in order to be eligible for a refund. You have five days to get in touch with us and request a refund if you're not happy with Brandically's design services. Within the first five days of the original design delivery, if no refund request is received, it will be considered that the initial designs were enough.

If you don't do anything with your order within 30 days after placing it, you won't be eligible for a refund. However, there will be a 30% fee if you choose to renew your design order.

For Combo/Special packages, similar refund policies apply as for single packages. A proof or receipt of service purchase is required to complete the refund process.

Refund Eligibility:

  • Before Delivery: A total refund (less a 10% processing and service fee) is eligible if the refund request is made before order delivery.
  • Within 48 Hours: A 66% refund (less a 10% processing and service fee) is eligible if the refund request is made within 48 hours of initial design delivery.
  • Between 48-120 Hours: A 33% refund (less a 10% processing and service fee) is eligible if the refund request is made between 48 and 120 hours of initial design delivery.
  • After 120 Hours: No refund is available after 120 hours of initial design delivery. However, we encourage you to contact us if you encounter any issues.

Refund Claim Process:

To claim a refund, please follow these steps:

Refund Rejection Policy

The following are some reasons for refund rejection:

  • Combo packages: Refunds are not available for Combo packages.
  • Irrelevant reasons: Refunds will not be issued for reasons unrelated to Brandically's services.
  • Lack of communication: No refunds if you don't contact us for more than 2 weeks.
  • Design approval: Refunds are not available after approving the primary design.
  • Policy violations: Refunds are not available if you violate Brandically's policies.
  • External assistance: Refunds are not available if you work with another designer or company for the same project.
  • Incomplete brief: Refunds are not available if your creative brief is incomplete.
  • Design changes: Refunds are not available for complete design changes.
  • Missed deadlines: Refunds are not available if you miss the refund request timespan.
  • Personal reasons: Refunds are not available for personal reasons like disagreements or changes of mind.
  • Service bundle refunds: Refunds are not available for individual services within a bundle.
  • Final delivery: Refunds are not available after the final files are delivered.
  • Free items: Refunds are not available for free items.
  • Time limits: Refunds are not available after 120 hours from the date of purchase for websites or logos.
  • Website development: Refunds are not available after approving the website design and sending it for development.
  • Additional services: Refunds are not available for downloadable software, domain name registration, or web hosting.
  • Lack of communication: Refunds may not be available if you fail to communicate for more than 45 days.
  • Business changes: Refunds are not available due to business name changes or closures.
  • Special offers: Refunds are not available for "Special Offers" that don't meet our standard package criteria.
  • Final delivery: Refunds are not available if the final delivery is taken.
  • Case-by-case basis: Website or design development refund requests will be evaluated on a case-by-case basis.

On-Hold Projects Clause

Should the client neglect to reply or communicate for a continuous 14-day period, the project will be closed and placed on hold. A reactivation fee will be charged if the client decides to pick up where the project left off after it has been closed.

Reactivation Fee

The reactivation fee for WordPress projects is $499 plus an additional cost that will vary according to the project's complexity. The reactivation fee for Shopify or Custom projects is $999, with an additional cost that will vary according to the project's complexity. The particular requirements and complexities involved in each sort of project will determine the complexity charge.

13. Intellectual Property

Brandically or its licensors own all intellectual property rights in the Site, Services, and Brandically's branding materials. None of Brandically's intellectual property may be used by you without our express written permission.

14. Disclaimer of Warranties

There are no express or implied guarantees of any kind, and the Site and Services are offered "as is" and "as available". All guarantees are expressly disclaimed by Brandically, including the implicit warranty of merchantability, suitability for a certain purpose, and non-infringement, among others.

15. Limitation of Liability

Even if Brandically has been informed of the possibility of such damages, Brandically shall not be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site or Services.

16. Governing Law

United States Of America laws shall control and be interpreted in relation to these Terms. The courts of United States Of America shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms.
